GUARDIAN AD LITEM'S MOTION FOR DISCHARGE
The undersigned Guardian Ad Litem, RAQUEL A. RODRIGUEZ, ESQ., hereby files this her Motion for Discharge as Guardian Ad Litem in the instant action, and in support would state as follows:
1. On or about February 24, 2009, the undersigned was appointed the Guardian Ad
Litem of the parties' two minor children, to wit: CARO DONATELLA SAN MARTIN, born on
February 2, 2005 and ISIS PENELOPE SAN MARTIN, born February 2, 2005.
2. Upon the appointment of the undersigned Guardian Ad Litem, the
undersigned met with the parents as well as with the children on several occasions. In
addition, the undersigned interviewed several surrounding witnesses, such as the children's
teachers, school counselors, psychologists, DCF investigators, as well as other family
members, also visited the children's school and has reported to the Court on various
occasions.
3. No other matters are pending before the Court at this time requiring the
participation of the Guardian Ad Litem. As such, the undersigned respectfully requests that
this Honorable Court discharge her of her duties as Guardian Ad Litem.
4. Although the office of the undersigned has tirelessly attempted to collect
payment towards the outstanding balance due of $6,520.89, the parties have not
cooperated or have not made a good faith effort towards payment of the fees incurred for
services rendered.
5. The undersigned is seeking the Court's guidance in resolving this issue as
provided in this Court's Order Appointing Guardian Ad Litem dated February 24, 2009.
