Intellectual Property Law Semester 1
This assignment deals with the law of copyright in the UK and the protection imposed upon copyrighted work. In the UK there are many forms in which an author’s right is protected in their work. The Copyright, Design and Patents Act 1988 was created fundamentally to protect the rights of authors work as well creating rights in which an author has to have his work protected against infringement. This act also sets out procedures to establish whether an author’s work has been infringed or not as well as setting out defences and acts that are permitted when it would be legitimate to use an author’s work. These exceptions are made in Chapter 3 of the Copyright, Designs and Patents Act 1988. In addition to the UK having guidelines for copyright, the Bearne Convention which was adopted in Paris in 1886, it protected literary and Artistic work around 150 member states now taking into consideration of the four principles. In addition to this is allows authors who are not national of the Bearne convention member state to obtain legal protection by publishing their work in a member state. Furthermore the Rome convention settled in 1961 the International Convention for the Protection of Performers, Producers of Phonograms, and Broadcasting Organisations has around 70 member states. It intends to balance the interests of performers, record producers and broadcasters. All of these interested parties can look to the Convention for defence against infringement of their legal rights. With all these different protection available to authors and creators copyright has become a large and debatable topic, especially as new technologies has widened the spectrum in the world of copyright and in ways things can be incorporated as being copied.
